Construction Practice

The firm’s construction work includes the representation of contractors, design professionals and third parties in all aspects of litigation, risk prevention and business consulting.  The partnership and its staff represent general contractors, subcontractors, architects, engineers, homeowners associations, property management companies, property owners, suppliers and other construction service providers.

 

The firm’s business profile includes handling disputes and consultation arising from construction of single family homes, condominiums or other multi-dwelling properties, commercial properties and construction site injuries, mold exposure and business-related conflict.  The firm is experienced in the retention and use of expert consultants in all construction disciplines and construction estimating.

General Liability Practice

The firm’s general liability practice includes the representation of property owners, business establishments, public entities, contractors and their employees. 

 

The firm’s business profile includes disputes arising from negligence, worksite injury and premises liability claims.  These cases occur throughout Northern and Central California.  The firm is experienced in the retention and use of expert consultants in the fields of medical evaluation, diagnosis and treatment, accident reconstruction, applicable building codes and other construction standards, evaluation of economic damage claims, and vocational rehabilitation.

 

The firm also negotiates and interprets indemnity language, additional insurance requirements  and other issues arising during the course of contract formation.

Real Estate Practice

The Firm has an increasing and varied real estate practice, encompassing transactional and as well as commercial and residential real estate litigation and consulting.  We represent property owners, brokers, developers, manufacturers, retailers, national property management  companies,  and  lease and license holders in real estate transactions and litigation, ranging from commercial, retail and industrial leasing to purchase and sale transactions.  We also have a substantial real estate litigation and dispute resolution practice, in which the attorneys handle real estate litigation matters of  nearly every type and scope, including Landlord/Tenant litigation, wrongful eviction and Habitability disputes, breach of lease actions, easement  and boundary disputes, purchase and sale agreement  conflicts, and  land use disputes. The Firm’s transactional expertise also includes the negotiation of commercial, retail and industrial lease and license agreements, purchase and sale agreements, construction documents, development  agreements.  Finally, the firm advises and represents building owners, and their management consultants, in the leasing of rooftop space for telecommunication equipment.

Kidd Carr LLP was formed in February 2005 to serve all counties in the greater San Francisco Bay Area, Sacramento, Central and Northern California. The firm’s primary objective is to provide high quality legal services at a reasonable cost, where  the firm remains committed to working closely and effectively in meaningful communication with its clients. The firm focuses on the construction industry, general liability, and real estate as its principal practice areas.

OUR ATTORNEYS

John N. Carr
PARTNER

John Carr received his undergraduate degree from the Babcock School of Business and Accountancy at Wake Forest University and graduated from the Santa Clara University School of Law.  While in school, he was a goalkeeper on the Wake Forest Men’s Soccer Team and assistant coach for the Santa Clara Men’s Soccer Team. 

 

Mr. Carr was a partner at the San Francisco office of Lewis, Brisbois, Bisgaard & Smith and also served as Staff Counsel for Reliance Insurance Company.  Mr. Carr has been a member of the California Bar since 1992 and initially worked at the office of the San Jose City Attorney.  His primary areas of expertise include construction defect litigation, personal injury defense , property manager defense, premises liability defense, landlord/tenant habitability litigation and toxic tort litigation. He has also tried plaintiff cases to verdict.

Mr. Carr offers mediation services.  In addition to his experience trying cases and representing parties at approximately 400 mediations and arbitrations, he has completed a 40 hour mediator training certification program and trained with several Northern California mediators.  He has been appointed to the ADR panel of several Bay Area counties.

Mr. Carr lives in the East Bay with his wife and three daughters. He served as a high school soccer coach for 8 years.  His interests include cooking, golf, hockey, soccer and travel.

G. Noel Kidd
PARTNER

Noel Kidd received his undergraduate degree from Stanford University and graduated from the University of San Francisco School of Law.  Mr. Kidd was a partner with Lewis, Brisbois, Bisgaard & Smith in San Francisco and served as Staff Counsel for CNA Insurance Companies in its construction litigation unit.  Mr. Kidd has been a member of the California Bar since 1992.  Mr. Kidd is an “AV” rated attorney and has excelled in the defense and consultation of architects, engineers and other design professionals, contractors, developers, and homeowners. Mr. Kidd  is also  experienced in handling  premises liability, landlord/tenant matters, personal injury defense, and large value product liability claims.  

Mr. Kidd lives in Marin County with his wife and two children, and remains active with many outdoor related activity interests, including surfing, skiing, biking, golf and travel.

Timothy Smyth
Associate

Timothy Smyth received his undergraduate degree from the University of California, Davis and graduated from Golden Gate University School of Law in 2008 with a Specialization Certificate in Intellectual Property.  While at Golden Gate University, Mr. Smyth was elected President of the University’s Intellectual Property Law Association by his peers.  Since becoming a member of the Bar, Mr. Smyth has aggressively represented both Plaintiffs and Defendants in complex civil litigation.  His primary practice areas include construction defect, products liability, personal injury, habitability, premises liability, and intellectual property.

 

Mr. Smyth lives in the East Bay with his wife and two daughters.  His interests include running, softball, board games, and travel with his family.

Melissa Cordova
Paralegal

Melissa Cordova joined Kidd Carr, LLP in 2009.  She brings over 25 years of litigation and paralegal experience to our firm.  Ms. Cordova is well versed in litigation support, all phases of discovery, document management and overall case management.  Her experience includes many areas of litigation, focusing solely on insurance defense since 1997.  She is the primary contact point for all scheduling, subpoenas, deposition and office management services for John Carr

Deborah Powers
Legal Assistant

Deborah Powers joined the firm in 2006. Mrs. Powers is well versed in litigation support, all phases of discovery, document management, and overall case management.  She is the primary contact point for all scheduling, subpoena, deposition and office management services for Noel Kidd. 

Carla Thelen Mendelson
Account Manager

Carla Thelen Mendelson has assisted the firm since 2008. Ms. Mendelson is an account manager and handles the firm's accounts payable, billing and receivables.  She is the contact person for any billing or expense questions and handles the firm's finances.  Ms. Mendelson brings over 25 years of accounting and bookkeeping experience to the firm, including her work as a CPA, a manager with Arthur Andersen, and as an accounting consultant specializing in small businesses.  Ms. Mendelson graduated from the California State University at Hayward with a degree in Business Administration and Accounting.
